MVT has put a letter on their website that was signed by the ATU signifying that we agreed not to apply to section 55 of the labour code. They are trying to paint our union as being duplicitous.

It is important to understand what section 55 is. Section 55 allows the union to unilaterally seek to force binding arbitration and has rarely been used. This type of binding arbitration is not what we are asking for. We are asking MVT to go together with us to jointly ask for mutually agreed upon binding arbitration. This would allow an arbitrator to explore all issues with both parties at the table and would hopefully bring a fair and speedy resolution to this labour dispute.

ATU local 1724 are not filing for section 55 of the labour code. We are asking MVT to join us in asking for binding arbitration. Unfortunately MVT has sent us a letter stating that they will not agree to seek binding arbitration.

ATU local 1724 wants to get to a settlement and restart serving our clients. MVT doesn’t understand that we will not agree to become slave labour. It is our hope that a third party might facilitate a resolution.

HandyDART passengers and our workers suffer while MVT tries to break us. TransLink is saving money while this dispute lingers on. Our workers can and will not go back to work until we gain a collective agreement that allows us to work and retire in dignity.
